Prize Draw
Terms & Conditions

1. Eligibility Criteria
1.1 The prize draw is open to New Zealand residents aged 18 years or older, who purchase GutterFoam products online via www.gutterfoam.co.nz or directly contact and purchase GutterFoam.
1.2 Employees of GutterFoam 2023 Ltd, their immediate families, and retail resellers are not eligible to participate.
1.3 For trade purchases, the winner will be the tradesperson who made the purchase, not the end recipient of the product. If a tradesperson wins, they are responsible for passing on the prize to the end recipient at their discretion.

2. Prize Details
2.1 The prize for each draw is one (1) CobbPro Black Gas Combo (Product RRP approximately NZD $400.00 including GST).
2.2 The prize is non-transferable and cannot be exchanged for cash or any other alternative.
2.3 The prize will be delivered to the winner’s provided address, with the cost of delivery borne by GutterFoam.

3. Entry Mechanics
3.1 Each purchase of 20 linear meters of GutterFoam products equals one (1) entry into the prize draw.
3.2 Entries are valid only during the month in which the purchase is made. For example, a purchase of 39 linear meters will count as one (1) entry, while a purchase of 40 meters will count as two (2) entries.
3.3 Multiple entries can be accumulated by making multiple purchases during the promotion period.
3.4 Entries will be tracked based on the date of purchase and the total linear meters purchased per transaction.

4. Promotion Period and Draw Dates
4.1 The promotion will run from 1 December 2024 to 1 April 2025.
4.2 One winner will be drawn each month. The draw for each month will take place on the 5th business day of the following month.
4.3 The winner will be chosen randomly from all valid entries using the online tool Wheel of Names. The draw will be screen-recorded to ensure transparency.

5. Notification of Winner
5.1 The winner will be contacted by email and phone within 24 hours of the draw.
5.2 If the winner cannot be reached or does not respond within 5 business days, a redraw will occur.

6. Prize Delivery
6.1 The prize will be couriered to the winner’s address at no cost to the winner.
6.2 GutterFoam will bear the cost of delivery within New Zealand.

7. Publicity
7.1 The winner’s name may be published on www.gutterfoam.co.nz/cobbgrill and may also be announced via social media.
7.2 The winner may be requested to provide a testimonial, though participation in promotional activities is not mandatory.

8. General Conditions
8.1 GutterFoam reserves the right to change, modify, or cancel the prize draw at any time due to unforeseen circumstances, including but not limited to natural disasters, changes in law, bankruptcy, or other factors beyond GutterFoam's control. In the event of such changes, the prize draw will be rescheduled at the next best available time if applicable.
8.2 GutterFoam is not liable for any delays or inability to award the prize due to circumstances beyond its control (force majeure).

9. Privacy and Data Protection
9.1 By entering the prize draw, participants agree to the collection and use of their personal information (e.g., name, contact details) for the purpose of administering the promotion, notifying winners.
9.2 Participants’ personal data will also be used for future marketing purposes unless they opt out of receiving marketing communications.
9.3 Participants’ personal information may be shared with third parties only for purposes directly related to the prize draw, such as organizing installation quotes for the product or other necessary tasks.

10. Force Majeure
10.1 GutterFoam will not be held responsible for any failure to perform its obligations under these terms if the failure is caused by an event beyond its control (e.g., natural disasters, pandemics, changes in law, or other force majeure events). Any delays caused by force majeure events will result in the prize being drawn at the next best available time.

11. Complaint and Dispute Resolution
11.1 Any complaints or disputes regarding the prize draw should be submitted in writing to GutterFoam 2023 Ltd at sales@gutterfoam.co.nz or by calling 0800 488 234.
11.2 In the event of a dispute, GutterFoam will endeavor to resolve the matter amicably and in accordance with New Zealand law.

12. Costs to Participate
12.1 There are no entry fees to participate in the promotion, but participants must purchase GutterFoam products to qualify for an entry.
12.2 Participants may incur their own costs related to internet access or phone charges when entering the promotion.

13. Compliance with New Zealand Law
13.1 The promotion is governed by the laws of New Zealand. By entering, participants agree to comply with all relevant laws and regulations, including the Fair Trading Act 1986 and the Privacy Act 2020.
13.2 Any warranty repairs or replacements for the CobbPro Black Gas Combo are to be handled directly by CobbGrill New Zealand, as the prize is a promotional item and no refunds will be offered.

14. Taxation
14.1 The winner is advised to consult a lawyer or tax advisor for any personal legal or tax advice, including any implications of receiving the prize (e.g., GST, income tax). GutterFoam makes no representations or warranties regarding the tax obligations of the winner.
